Do not go it alone!
WE have over 30 years of experience.
Welcome to the The Law Offices of Howard B. Herskowitz. We specialize in Personal Injury law, covering all types of bodily injury claims as listed below, the majority regarding injuries from automobile accidents. The moment you hear the crunch of metal and the shatter of glass from a car accident, your life becomes more difficult and complicated. You have pain, worry, medical bills, car repairs, lost income during recovery, and other expenses, as well as your pain and suffering. The last thing you need to deal with is the uncaring, profit-motivated insurance company. You do not want to have to fight through the insurance company’s complicated claims procedures that were created in an attempt to discourage you from obtaining the recovery for your monetary losses and your pain and suffering you are entitled to receive. Unfortunately, the at-fault individual(s) and/or corporation(s) and their insurance carriers often trample on these rights. Our firm protects your rights in all these types of cases, and we are available for at-home and hospital consultations, as well as evening or weekend consultations, as needed.
No Attorney’s Fees If No Recovery – FREE CONSULTATIONS!
When our firm accepts representation, we understand that the vast majority of our clients cannot afford to pay expensive hourly attorneys fees. Instead, our firm accepts representation on a contingent basis. That means that if we do not succeed in obtaining a monetary settlement or verdict for you, we do not get paid. On the other hand, if we do prevail with a settlement before litigation is filed, we are paid 1/3, (also referred to as (33-1/3%) of the gross settlement in addition to any out-of-pocket costs and expenses we advance. If litigation must be filed, our firm is paid 40% plus costs and expenses we incur along the way.
Auto Accidents
Car accidents are notoriously one of the leading causes of death in the United States. Every year tens of thousands of people die in car accidents while millions more suffer serious or permanent injuries. See more below under “The Most Important Auto Insurance to Own…”
Slip and Falls; Trip and Falls
Slip and falls and trip and falls are among the most common types of accidents that exist, whether from a slippery floor or a barrier that you trip over. Slip and fall accident lawsuits are expected to increase over the next few years as the age of the U.S. baby-boomer population increases.
Dog bites
Every year, thousands of Americans are bitten by animals―most often dogs. In many cases, a person bitten by an animal may have a legal right to recover damages from the animal’s owner or another responsible party.
Wrongful death
A “wrongful death” occurs when a fatality results from the negligence, recklessness, intentional harm or misconduct of another individual, company or entity. An action for wrongful death belongs to the decedent’s (dead person’s) immediate family members (often called “distributees”), or as directed by the decedent’s last will and testament and/or trust.
Nursing Home Neglect
Nursing homes are supposed to be safe havens, places where seniors who lack facilities for self-care go for treatment and compassion. Unfortunately, some get just the opposite. Alas, abuse, neglect, and other forms of mistreatment abound in America’s nursing homes.
Faulty Products
Thousands of consumers are injured by defective products each year. A products liability claim may exist when a company designs, manufactures or sells a product which contains an unreasonable danger or defect making the product unsafe and which results in a person’s injury or death.
Boating Accidents
Florida’s many beaches, rivers, lakes, bays, and canals make this state a favorite vacation spot for tourists, residents, and college students wanting to enjoy themselves while swimming or riding on sailboats, yachts, fishing boats, houseboats, jet skis, and other personal watercrafts. Unfortunately, boating and water-related accidents do happen, and personal injury claims can be made if the vessel and/or site in control is/are being operated negligently.
The Most Important Auto Insurance to Own – Uninsured Motorist Coverage (UM)
Regarding auto accidents, the current law requires that the person and/or entity causing the accident pays through their auto insurance for your outstanding medical bills and lost income not covered by your own required car insurance. However, under a horrendous Florida law, at-fault drivers are not required to purchase bodily injury liability coverage for your outstanding medical bills and lost wages in addition to your pain and suffering. The sad truth is that your own insurance carrier may have failed to provide you with uninsured motorist coverage, or under-insured coverage (otherwise known as UM), arguably the most valuable coverage for car accident victims that exists. UM will cover you for the missing liability bodily insurance the at-fault driver should have had.
We advise all clients and all other citizens to demand from their auto agents as soon as possible to provide as much UM as you can afford to maximize your protection. UM is so valuable that it will cover any passengers in your car. It will also cover you and your resident relatives if you/they are drivers or passengers in a car owned by a 3
Our Firm Will Fight for You
We have more than 30 years of experience successfully handling thousands of personal injury related cases, from settlement to trial.
Unfortunately, the large corporate insurance companies’ lobby has great influence in our state government in order to reduce what they should pay in claims. Often, the insurance companies’ claims representatives are instructed by their superiors to pay attention only to advancement of their corporate ownership and officers, resulting in very poor handling of your claim and failure to fairly evaluate your claim. They have huge political influence with our state government to pass legislation that favors them against you.
If you have an ongoing personal injury claim that you are trying to handle yourself, the insurer knows that if they can delay resolving your claim long enough, you may lose your focus and morale, becoming exhausted from the process, so that you will settle for a fraction of the sum you are entitled to. That is one of the many reasons you need an experienced personal injury lawyer on your side.
